Stolen Picture

So, this is the price we pay for indulging in social media, I guess.

I am thrilled to have reconnected with so many friends on Facebook.  One of them sent me this message yesterday:

Alright, so how’s this for random: I’m in the car, taking my wife for a check up, pass by a new grocery store and notice that they have a picture of you, your husband and two kids on the store front window. Life size. I kid you not. Will take a photo of it later today and send….

What you don’t know from this message: this college friend lives in the CZECH REPUBLIC.

Clearly, my family did NOT take a picture for any advertisements – either here or abroad. And, clearly, whoever hijacked the picture assumed no one would recognize us so far away. Hmmmm…wrong. :)

I’ll admit, there is an element of flattery (I think) to the whole thing.  But still, there is something creepy about knowing our family picture was stolen from one of my sites. This picture has been on my blog, used as a Christmas card and put on a few Ning Networking sites. It is also on my Facebook page (which is one of the reasons Justin recognized us) but my FB page is open only to friends.

Perplexing.

According to my friend, Justin, the translation reads:  “We will prepare and deliver your requests in two business days.”

Interesting.  Bizarre. Flattering, I suppose.  But quite creepy.

This picture was taken by a friend of mine, Gina Kelly.  She does give me the rights to the pictures she has taken – and has authorized me to use them on my site, etc.

Updated, Saturday, June 6th.  Based on the comments I’m seeing, I feel compelled to clarify a few things. 1) I am the author of this site – Danielle.  Not my husband.  Quite a few comments have been directed to him. 2) I take FULL responsibillity for posting this picture with the incorrect resolution (read: too high).  Clearly, I am not a professional photographer and should have made the resolution smaller and/or watermarked the picture. 3) I used the incorrect term in one of my comments – the photographer did sign a release for me to use the pictures, and certainly, this does not mean I ‘own’ them. 4) While the photographer certainly may sell some of her pictures as stock, she ALWAYS has the subjects sign a model release.  I didn’t sign one for this picture, but would have if she had asked. 5) I posted this story because I think it is INTERESTING – what are the chances a friend who see this ad thousands of miles away? AND because I was SURPRISED it happend. Like many of you commenting, I wasn’t aware pictures could be taken.  If this makes me naive, so be it.  Now I know. And, for the record, I will not stop using pictures of my family on my site – I will however, change the format. 6) I am grateful to the greatest percentage of people who have commented with very interesting thoughts.  However, if you are part of the smaller percentage who are commenting only to say that a member of my family (or all of us) are ugly, I won’t be approving the comment.  I won’t allow it on my site.  I imagine you understand.  Thanks for stopping by!

    I do my fair share of blog surfing, you know visit a blog I like, click on a link, and then another, and so on! I’ll bookmark the ones I like for a later time and then go on about my day.

    Just a thought… have you contacted the photographer to see if they actually did sell the photo as a stock image?

    Elle raised a very good point. I hadn’t noticed before but it does look like your ds’s smile is different. Like it’s another pic taken in succession, or they photoshopped it.

    On second study, your dd’s head looks like it faces the camera ever so slightly more on the storefront. In that one she looks more straight forward, and on the original pic her head is slightly turned in to your dh.

    Your friend’s photography site has samples of her work. Is there any chance she posted a slightly different picture there? Not that it matters in the end – theft is theft. But it would make me feel better to think my pic was stolen from a photography site (a likely spot for would-be theives to lurk) rather than my personal blog.

    Sorry you are dealing with this. :(

    Of course it’s really hard to tell since the pic quality on the store window isn’t that great with the glare and all.

    Lindsay~ First of all, thank you. And you are right, I am pretty calm about it. My initial reaction was much like yours – and probably not that clean…but I’m truly grateful the ad is benign – and not *gasp* pornographic. I want to get to the bottom of this….exploring options now.

    Amy – I’m being told that ‘no’ we aren’t ‘safe’ if we are posting virutally anything. A reporter friend of mine told me they are ‘allowed’ to take anything off FB and MySpace, but not copyrighted pics off blogs. The other sticking pt – are they gaining financially via my family pic? I’m thinking so…hmmmm :)

    OMG this is really scary… I deal with copyright stuff all the time with my business but those are just designs. I could not imagine it being my family. I say go after them.

    I showed this to my husband – he says it is facebook. They have rights to your photos and sell them for a profit. They don’t want you to know this but read in the find print of your agreement! Absolutely disgusting……

    That’s the craziest thing I’ve heard. NUTS. What are the chances of finding out?

    You have to wonder when they took the picture the conversation that went with it: “Do you think we’ll get busted?” “Nah — what are the chances they’d EVER see it?”

    What an odd thing that I’m sure you were not expecting to deal with this week. Could they not have dropped $5 on istockphoto to get a family pic?

    Just plain weird.

    This same thing happened to Stephen Colbert with a men’s clothing store in Iran. He showed the photo as originally appeared in Esquire magazine, and then photos of the huge storefront ad. The photos are posted here: http://www.nofactzone.net/?p=11861 It would be worth seeing if anything came of it in his case… he would have the resources to track it down… and, as a celebrity, more need to avoid seeming to endorse stores without his knowledge.

    Many have mentioned copyright laws and such… but this was done in another country, so I would think it has to go by their laws, which might be very different from ours.

    wow. i’m in advertising, and just so you know, you have full right to sue, and really, you should. this might not be a bad representation of your family, but you would never want that image to pop up in a place that would be 100% against. if they don’t think anyone will catch them, the could claim the image as their own and sell it for other people to use. NOT COOL! good luck with whatever you choose to do, but i would demand that it’s taken down and sue.

    Very weird, in the fact that they could take a very low res, small image from your blog and make it so clear blown up to the size it is. I mean, there are some good Photoshoppers out there, but they’d get a very blurry image if they took it off of the link you posted above. Any other way they could have gotten a bigger, higher res image? Weird! (And yes, creepy!)

    Mentioned this to hubby- he says this is HIGHLY illegal, and you should contact the company. Otherwise it’s a lawsuit waiting to happen. Then he said he’d be surprised if my pic wasn’t up in another country too- wow, maybe put a copyright symbol across it. So strange. But you guys do look great, regardless of whatever you are advertising.

    Oh my gosh! I saw this at my friends Soliloquys and I just had to come over and see for myself. This is CRAZY.

    I put so many pictures of my kid and well, basically, everyone and their brother on my blog! It is a little insane. Are you going to call the store and see how they got the picture?

    I’m not surprised, really – I know how small graphics companies are always on the look-out for attractive, copyright free images AND I’ve heard too many stories of pictures being redistributed in innapropriate ways online.
    So I don’t post anything online that is recognizable of my kids or family, sadly.

    Unfortunately, now that you know about it, you must sue in international court or you are actually giving them permission to do it by not taking action.

    Most international court lawyers are in NY. You should definitely find out if the store is using it in Great Britain, because Great Britain would be a country that would be more prepared, in some ways, to deal with this and you would probably get a very large sum of money in apology.

    It’s imperative that you follow through.

    Dear Danelle,
    I am not sure if you have any copyright rules but this looks like a professional photograph taken perhaps as a family photo. If that is the case the photographer certainly has copyright on the photo and may have a case to be awarded money for using the photo. I think in this age of social media if we put ourselves out there on public sites this is bound to happen. I would also consider it flattering. Great picture by the way. What a beautiful family.
